These terms are between you (the repair facility) and HVN Group Limited, a Hong Kong company, for use of SuppSmith at suppsmith.com.
1. What the service does
SuppSmith reads an insurer's estimate, normalises it, applies a versioned rules engine, and produces a flag report — items that appear to be missing or underpaid, each with an estimated dollar impact at your rates and a citation to the source. On Pro plans it also drafts suggested supplement lines and justification wording.
2. What the service does not do — and cannot be made to do
- We do not communicate with insurers. There is no submit button, no carrier integration, and no adjuster-facing channel. We will not add one.
- Nothing is applied without you. Every flag requires your explicit acceptance before it enters a package.
- You submit. You review the suggested lines, key them into your estimating system, and submit the supplement yourself, exactly as you do today.
- We are not giving you legal, insurance or professional advice. Flags are analysis. Citations point at published material; they are not an opinion that you are entitled to payment.
3. Your responsibilities
You are solely responsible for everything you submit to an insurer.
In particular: you must not submit a supplement line for work that was not performed, or
for a part or operation that was not necessary. That is insurance fraud, it is a crime,
and a SuppSmith flag is not a justification for it. A flag says an item appears to be
missing from the estimate — determining whether the work is actually required on the
vehicle in front of you, and whether it was actually done, is your judgement and your
obligation. See acceptable-use.md.
You also confirm that you have the right to upload each document; that you will verify each flag against the vehicle, the damage, and your own subscriptions to estimating and OEM repair information before relying on it; and that your rates, carrier list and shop settings are accurate, since dollar impacts are calculated from them.
4. Accuracy
We work hard on accuracy and we measure it — per-field extraction accuracy and per-rule precision are release gates. We do not guarantee it. Parsing can be wrong, especially on scanned documents; a rule can fire where it should not; a dollar impact is an estimate.
We make no promise about recovery. We do not guarantee that any flag will be accepted by a carrier, that any supplement will be approved, or that you will recover any amount. Any figures we publish are observed results from past estimates, not a forecast of yours.
5. Citations
Flags carry pointers to published material — procedure pages, OEM position statements, DEG inquiries, industry guides — with a short paraphrase and at most a one-sentence attributed quote. We do not reproduce that material and we do not license it to you. You are responsible for holding your own subscriptions and for reading the source before relying on it. A citation is a pointer, not a copy.
6. Your data
Your estimates and the data derived from them are yours. We handle them under
privacy.md. We claim no ownership. We will not share them with any insurer.
We may use aggregate, de-identified statistics about accuracy and outcomes to improve the
service. This never includes your documents, your customers' information, or anything
identifying your shop, and it is separate from sample-estimate-contribution.md, which
governs free-audit uploads and requires your consent.
7. Plans, billing and trials
Plans are Starter, Pro and Multi-site; current features and prices are on the pricing page and may change on notice for the next billing period.
Payments are processed by Paddle, which acts as merchant of record for the transaction. Your purchase is also subject to Paddle's terms, and Paddle handles invoicing, tax and payment-method issues. Subscriptions renew automatically until cancelled. Cancel any time; access continues to the end of the paid period. Where a free trial or free first month is offered, it converts to a paid subscription at the end of the stated period unless you cancel before it ends.
8. Acceptable use
acceptable-use.md forms part of these terms.
9. Availability
We aim for high availability and do not promise it. There is no uptime SLA on Starter or Pro. We may take the service down for maintenance, and will give notice where we can.
10. Suspension and termination
You may close your account any time. We may suspend or terminate an account that breaches
these terms or acceptable-use.md, that puts us or our providers at legal risk, or that
does not pay. Where the breach is curable and not serious, we will tell you and give you a
chance to fix it first. On termination you may export your data; after 30 days we delete
it per privacy.md.
11. Disclaimers and liability
The service is provided "as is." To the fullest extent the law allows, we disclaim implied warranties of merchantability, fitness for a particular purpose and non-infringement.
To the fullest extent the law allows, we are not liable for lost profits, lost revenue, lost or denied supplement recovery, or indirect, incidental, special or consequential damages. Our total liability for any claim is capped at [LIABILITY_CAP — not set].
Nothing here excludes liability that cannot lawfully be excluded — including for fraud or for death or personal injury caused by negligence.
Unresolved: [LIABILITY_CAP — not set] is typically set at fees paid in the preceding 12 months. Confirm with counsel, and check enforceability in the US states where customers are concentrated.
12. Indemnity
You will indemnify us against claims arising from your submissions to insurers, from
documents you had no right to upload, and from your breach of these terms or
acceptable-use.md.
13. Changes
We may change these terms. For material changes we will email account holders at least 30 days before they take effect. Continuing to use the service after that is acceptance.
14. Governing law
Unresolved. HVN Group Limited is a Hong Kong company; customers are US repair facilities; Paddle is merchant of record. Hong Kong law is natural for the entity but unattractive to a US customer and awkward to enforce against one. A US state is the likely answer. Do not publish with a placeholder.
